The Los Angeles County District Attorney's Office has decided not to file charges against Mark Salling, according to People. Salling had been accused of raping a woman, but, according to the District Attorney, there was "insufficient evidence" to file the charges.
The victim claims that she and the former Glee actor were dating in 2012 when she changed her mind about having intercourse with him. According to her, Salling refused to stop when she said no and forced himself on her.
The police report was filed earlier this year, and, despite the report coming four years after the alleged incident, the victim claims that she got the courage to report him after Salling was arrested in December 2015 for possession of child pornography.
"She appeared very emotional over the trauma inflicted upon her and presents as a credible and accurate historian of the events surrounding the rape," said deputy district attorney Emily Spear, who interviewed the victim. "However, given the delay in reporting the crime, suspect's apparent denial of the rape in victim's pretext to call to him and lack of other corroboration, there is insufficient evidence, at this time, to file this case."
This does not mean the end of these allegations for Salling, however. The deputy also explained, "if more evidence is discovered in the future, that the case may be reopened and presented again for filing."
Salling has not responded to the recent allegations made by the victim.
This isn't the first report of Salling finding himself in legal problems. He was named in a two-count indictment in May of this year where investigators claim that he had received and possessed videos and still images involving young girls. Salling pleaded not guilty to these charges.
He was also sued in January 2013 by Roxanne Gorzela, an ex-girlfriend, for sexual battery, assault, intentional infliction of emotional distress and negligence. Gorzela said that he had "pushed her to the ground during an argument after forcing her to have sex without a condom." After the sexual battery charge was dropped, Salling agreed to pay her $2.7 million in a settlement.
