Singer-songwriter Frank Ocean seems to have a bit of a problem on his hands. The artist best known for his song “Thinking ‘Bout You” is being sued by producer/songwriter Micah Otano. Along with Ocean, producer Malay is also being sued (individually). Otano is also corporately suing Island Def Jam and Universal.
Otano’s story goes as follows: he claims that he wrote a song entitled “Daylight” with fellow producer Malay. Otano claims that he provided both the lead synthesizer parts and piano on the track. Malay promised co-producer credit when he was shopping the song, but by the time “Daylight” made it to Ocean it soon took on the name “Lost.” The track appeared on Ocean’s Grammy Award winning album channel ORANGE and was the fourth single to be released. Otano is also claiming that “Malay (through his lawyers) lied to Otano, claiming that Malay ‘completely re-recorded’ Otano’s work in the process of creating ‘Lost,’” according to the lawsuit which was filed in California on March 6th. “Malay did so in order to convince Otano to sign away his rights in “DayLight” for $1,500, despite the fact that Malay diduse Otano’s performances in Lost.’ “
The amount that Otano is seeking has not been released but he is suing for breach of contract, fraud in the inducement, rescission and restitution, copyright infringement, and declaratory relief.
No word from Ocean’s camp regarding the claims. Following up his Grammy win Ocean has been busy checking out Fashion week stopping into shows such as Dior, Chanel and Givenchy. Clearly he isn’t letting this news get him down!
