This just makes me lose faith in humanity.
Pearl Fernandez and her boyfriend, Isauro Aguierre, are being brought up on charges of capital murder. They are being charged with beating Fernandez’s 8-year-old son to death.
The couple plead not guilty to these charges. Fernandez’s son, Gabriel Fernandez, died in 2013 after being routinely “abused, beaten, and tortured more severely than many prisoners of war.”
According to Advocate, Fernandez and her boyfriend spread Gabriel’s torture out for eight months. His older siblings gave the court a full report of offenses against their mother and her boyfriend.
Gabriel almost made it out of the house on May 22, 2013, when he would have come into state custody. Pearl Fernandez called 911, reporting that her son “wasn’t breathing.” Paramedics found him naked on the floor with several different wounds from his rib cage down. Gabriel also had a split skull, which his mother claimed he got by hitting his head on the dresser.
Gabriel died two days later.
The case made Los Angeles headlines last year, prompting calls for reform to child welfare programs. Gabriel’s teacher and grandparents made several calls to social services, but nothing conclusive was ever found. Sources report, however, that these workers never checked for bruising under his clothes.
Two employees have since been fired, while a third is trying to appeal the motion for their termination.
Fernandez and Aguirre each face charges of capital murder with special circumstances of torture. It is still unclear whether or not prosecutors will seek the death penalty.
