The drama might just be coming to an end and a happy ending in sight, as Kelly Rutherford has won her custody battle and has been re-united with her children.
The Gossip Girl actress was embroiled in an ongoing custody battle, and it was ruled by Los Angeles Superior Court Judge Mark Juhas that Rutherford would be given temporary sole custody rights to her two children, Hermes and Helena, who are to brought back to the U.S. from Monaco.
The saga has been ongoing for 6 years, as Rutherford has been battling, in and out of court, to be granted temporary sole custody of her children after her ex-husband kept them in Monaco after his U.S. Visa was revoked.
Rutherford had to travel to visit her children, and appealed to the Superior court after the children’s father asked for the children’s passport be given.
This is a fantastic win for Rutherford, who will travel to Monaco this week to retrieve her children.
The judge decreed that it would be in the “best interest” of the children for them to stay in one place.
Rutherford first took her case to the Federal court, where her petition was denied, so this is tremendous news for the 46-year old mother of two.
She said, in an interview with ABC News:
“I can sit here and tell you how often I cry…I can tell you how it feels to leave my kids in a foreign country…to see them after not seeing them for weeks on end.”
She is traveling to Monaco, and is “optimistic” that Daniel Giersch, her ex-husband and father of her children, will co-operate fully.
